Recipient terms

This is a non-binding English translation provided for your convenience. The legally binding version is the German text.

These terms apply to everyone who receives promos from Emsig Radio: DJs, radio and press people, playlist curators, bookers and promoters. Emsig Radio is operated by WL Artworld Solutions GmbH, Weydingerstraße 6, 10178 Berlin, Germany (see the imprint). We address you as "you", the way our mails do.

Promos are advertising for music that labels and artists commission from us. You receive them only because you agreed to, and you can withdraw that agreement at any time. We pay nobody to play, review or book a record, and nobody pays you to. What you do with a release is your decision.

1. How you get on the list and off it

There are three ways onto the list:

  • You sign up through the "Get promos" form and confirm your address with the code we send you. Nothing happens without that confirmation.
  • A curator at Emsig Radio invites you. Nothing goes out then either until you have confirmed the invitation.
  • We already know each other. Where a working relationship exists, we record who at our company confirmed when that you want promos from us.

Getting off takes one click: every promo mail contains an unsubscribe link that works without logging in, and your email client can trigger the unsubscribe itself. It takes effect immediately and for all lists. If you only need a break, the settings page lets you pause for one, three or six months, leave individual pools or exclude individual labels. None of that is an unsubscribe.

2. How often we write to you

We write to you at most as often as your send cap allows. Our own cap is currently four mails a month and two a week; you can set yourself a lower one, never a higher one. It applies across all campaigns and labels: three campaigns in one week do not mean three mails from three lists. We do not write at night or at the weekend, counted in your time zone where we know it.

A mail from us has no attachment. It contains a personal listening link, a short introduction and, when a curator has something to say, a personal note. If a mail bounces repeatedly, we rest your address for thirty days before trying again.

3. The listening link is yours

The listening link in every mail is signed and meant for you alone. Whoever holds it can open the page without logging in, so please do not pass it on. Streaming is always available immediately. Before a download we ask you for a short reaction (section 4). If the release is under embargo, you can listen and write to us until the embargo date; downloads open afterwards, where the label has set it that way.

4. Your feedback and who sees it

Feedback consists of a rating, what you intend to do (play, chart, review, book or "not for me") and an optional comment. "Not for me" is a complete answer and is never held against you. It helps us send you something more fitting next time.

The label that commissioned the campaign sees your feedback in its campaign report, together with your name and your outlet. That is the point of the feedback, and you should know it before you give it. What the label does not see: the lists you are on, the other recipients, and anything you tell us only in your settings.

5. When we may quote you by name and when we may not

You are quoted publicly, on a one-sheet, in a press release or on a website, only if you expressly allowed it when giving feedback ("My comment may be quoted publicly"). Without that permission your comment stays between you, us and the label; the label is bound to us to respect that. Your permission covers the comment you released, together with your name and outlet, and only for this release.

You can withdraw a permission later by changing your feedback on the listening page or by writing to us. A quote the label has already published with your permission by then cannot be recalled, but we make sure it is not used again.

6. Personalised downloads

A label can decide for its campaign that downloads are personalised. Every file you download then carries an inaudible watermark that refers to your send. If an unreleased recording turns up somewhere it should not be, this makes it possible to tell which send the file came from. It does not change the sound, and whether a campaign is watermarked is stated on the listening page before you download.

We say this openly because it is a rule of the club, not a trap: promos run on trust, and we want to share that trust with you rather than turn it against you.

7. Embargoes and unreleased music

What we send you is often not yet released. Please treat it that way: do not publish it before the release or embargo date, do not stream it publicly, do not pass it on, do not upload it. Playing it in your own programme, in sets and on air is exactly what we hope for, from the date the label names on the listening page, or immediately where there is none.

8. What data we hold about you and for how long

All of it is in our privacy policy, section 5. In short: your profile with your settings, what we sent you, how far you listened, what you downloaded and your feedback. No IP addresses on the listening pages, no location, no tracking pixels in mails, no analytics tools. After an unsubscribe your profile is deleted six months later. A hash of your address stays on a suppression list so that you receive nothing further from us, even if a label imports you again later.

9. Your rights

You have the rights of access, rectification, erasure, restriction of processing, data portability and objection under the GDPR, and the right to withdraw your consent at any time. You change your settings yourself through the link in every mail or under "Access". Everything else, such as a full export in a machine-readable format or an erasure, you get on request to [email protected]. On erasure we remove the text of your feedback; the ratings remain as numbers with no reference to you, and the suppression list remains.

10. If we change these terms

These terms are versioned. Which version you confirmed is stored with your consent. If we change something that affects you, we tell you in the next mail and you can unsubscribe with one click. German law applies. The German version is authoritative; the English one is a translation.
